These Terms and Conditions constitute the Agreement between you (individually and as a group; hereafter referred to collectively as “Passenger”) and Goodspeed & Bach, Inc. as well as its affiliates, employees, subcontractors, agents, officers and directors (hereafter referred to collectively as Goodspeed).
Rates are in U.S. dollars. Rates are per person double occupancy (unless otherwise specified in the program) and are subject to change only due to currency fluctuations (with or without notice). Hotels, restaurants, etc. and guide services may be changed by operator at its discretion.
Twin and/or double bedded run of house rooms, (unless a specific room category is requested and confirmed) with private facilities at hotels as listed for each program. Goodspeed reserves the right to substitute hotels of a similar category at any time. Guests checking out of hotels beyond listed hotel check-out time will be charged an additional night’s rate at published FIT rates.
Items generally not included
• Passport fees and bank charges
• Baggage, medical and personal insurance of any kind
• Meals, beverages and sightseeing other than those listed in the specific itinerary
• Car insurance
• Any item of a personal nature (Excess baggage charges, laundry, liquor charges, mineral water, gifts and souvenirs, etc.)
• Any incidentals in the hotels (room service, minibar, laundry services, etc.) These charges must be settled by the passenger directly with the hotel(s)
• Tips and gratuities to the trip director, driver, bellman, local guide.
• Taxes and service charges
• Travel insurance
• Optional excursions
Passengers deviating from group (or package) will not be entitled to a refund for portions of package not used.
1. BOOKING and CANCELLATION INFORMATION – INDIVIDUALS
All cancellations must be done in writing and sent to Goodspeed in its New York office.
1a) Deposits and Payments: A $500.00 deposit with a signed registration form is required at the time of booking. A reservation cannot be confirmed until the deposit is received in the Goodspeed office. Final payment is due in the Goodspeed office 60 days prior to departure.
1b) Cancellation Charges (Land program): More than 4 months prior to departure 5 % of the program cost – per passenger; 4 to 2 months prior to departure, 25% of total price; 60 days prior to departure, no refund. Changes of any kind will be subject to a $100 surcharge per passenger. Tour spots are not transferable. No refund for unused portions of the tour package.
1c) Air Transportation: Air transportation may be included and may be on non direct flights and are non refundable and non endorsable. Transfers may be by bus or trains etc. Please note that the air portion of the packages shall be confirmed only after receiving your payment. We are not responsible for non-availability of flights and in such event money already paid will be refunded in full with no penalties. Extra charges may apply to the flight portion if the departure city is not one of the gateway cities or if the air allotment has been filled from that city. Passengers or their intermediary are responsible to insure that their names are properly spelled for the airlines. Name spelling must correspond with that printed on a valid passport.
1d) Cancellation Charges (Air): Air payments are non refundable (with the exception of non-availability of flights after payment has been received by us.)
Important note: Bookings are automatically cancelled if money is not received on time in the Goodspeed offices and penalties as per cancellation charges will be applied. If Deposits have been received, the client will automatically forfeit that money.
2. BOOKING and CANCELLATION INFORMATION – GROUPS
2a) Deposits and Payments: A non-refundable deposit of $1000.00 is required at the time of booking. The next deposit of 25% of the total price is required in the Goodspeed offices 3 months prior to departure. The remainder of the group price is due in the Goodspeed offices 45 days prior to departure. For the benefit of the group rate, one person must be handling all matters for the group. That person will provide Goodspeed, as per the Terms & Conditions, payment for all passengers.
2b) Cancellation Charges: Deposits are non-refundable. Up to six months prior to departure, deposits may be applied toward individual bookings on the same tour or another tour at the discretion of Goodspeed & Bach, Inc. Less than 2 months prior to departure, there no refund. Changes of any kind will be subject to a $100 surcharge per passenger. No refund for unused portions of packages. Individual rate increases will be applied if the number of passengers is reduced for a group. Cancellation received within 2 months of departure is subject to forfeiture of the entire group tour. If the travel program is cancelled or interrupted prior to 50% of completion for any reason, the sponsoring organization forfeits any proceeds.
Important note: Bookings are automatically cancelled, and deposit forfeited if money is not received on time in the Goodspeed offices. Penalties as per cancellation charges will be applied.
TRIP CANCELLATION AND TRAVEL PROTECTION
Trip cancellation, personal, and baggage protection are strongly recommended for all Passengers. Our own statistics indicate that most cancellations occur for events out of the control of most of us (broken limb, death in the family, medical problem, jury duty). Travel protection is available from Goodspeed. Cost of protection, is non-refundable if the trip is cancelled by the passenger at any time.
VOUCHERS AND INVOICES
It is the client’s responsibility to check the accuracy of the information on vouchers and invoices.
Goodspeed does not own or operate hotels, air or other land transportation mechanisms, or other entity which is to provide goods or services for your trip. Consequently, Goodspeed is not liable for any negligent or willful act or failure to act of any such entity, person or of any third party, or for any condition or circumstance beyond its direct control. In addition, and not in limitation thereof, Passenger agrees that Goodspeed, Inc. is not responsible for any act or failure to act, whether negligent or willful, of any person who is to or does provide any goods and services for your trip. Moreover, Passenger understands and agrees that Goodspeed is not responsible for injury, death, property damage, delay, inconvenience or loss occasioned by theft or vandalism, fire, water, weather conditions, terrorist activity, violence, acts of God, strikes or other labor unrest, riots, governmental acts, maintenance, cleanliness, sanitation or other problems with vessels, hotels or transportation mechanisms, hotel and/or vessel overbooking, delays of airlines or any other transportation mechanism. Receipt of deposit constitutes agreement to these terms and conditions.
Any controversy or claim arising out of or relating to these Terms, to your trip or to any material disseminated by Goodspeed concerning your trip including, without limitation, any claim related to illness, injury, delay, property damage, inconvenience or death shall be settled solely and exclusively by binding arbitration in New York City, New York in accordance with the then current rules of the American Arbitration Association. Any such arbitration will be governed by substantive New York law.
PHOTOGRAPHY ON TOURS
Goodspeed reserves the right to take both still and film or video pictures (“Pictures”) and record sound (“Sound Recordings”) during any tour and to use such Pictures and/or Sound Recordings for promotional and advertising purposes. The Passenger hereby permits Goodspeed to use his/her image and voice in such Pictures and Sound Recordings without any payment due to the Passenger whatsoever. The Passenger must notify the Goodspeed New York office in writing that he/she does not grant Goodspeed permission to use such Pictures and Sound Recordings.
This agreement and contract supersedes and cancels all prior communications and agreements whether written, oral or implied. No provision in this agreement can be modified except upon writing, signed by an officer of Goodspeed. Goodspeed reserves the right to: (a) cancel any itinerary in whole or in part; (b) make such alteration to any itinerary as it deems necessary or desirable; (c) refuse to accept or retain as a member of a tour any person at any time. Upon booking and deposit payment for any tour, this Agreement shall be deemed transacted in the State of New York. Any inquiries, claims or general complaints by the Passenger relating to the services provided by Goodspeed must be submitted in writing to the New York office of Goodspeed within thirty (30) days of the completion of the tour, and must contain detailed information.
FLIGHTS AND DESTINATIONS
Goodspeed has no special knowledge about dangerous flight conditions or dangerous conditions at your destination. For more information, continue to read the general press on those conditions, and for updates, check the Web sites of the Federal Aviation Administration and the State Department. In consideration for Goodspeed’s issuance of the travel documents that the Passenger requests, Passengers agree to release Goodspeed from all claims arising out of the foregoing.

JURISDICTION Unless otherwise specified, the Materials in the site are presented solely for the purpose of promoting travel programs, services, and other products available in the United States, its territories, possessions and protectorates. Any offer for any travel programs, services, or products, made in the Materials is void where prohibited. This site is controlled and operated by Goodspeed from its offices within the State of New York, United States of America. Goodspeed makes no representation that Materials in the site are appropriate or available for use in other locations. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable.
